THIS IS A SKILL AND KNOWLEDGE-BASED, NON-GAMBLING CONTEST.

The Honus Bonus Fantasy Baseball Contest (collectively, the “Contest”) features five separate monthly fantasy baseball contests (each such contest, a “Game”). By registering for the Contest and/or entering or participating in any Game, you agree to these official rules (“Official Rules”).  These Official Rules are a binding contract, so read them carefully before participating.  By entering and/or participating, each entrant/participant (“entrant” or “you”) agrees that he/she has read these Official Rules and to abide by and to be bound by the terms and conditions herein. 

 

1.     CONTEST PERIOD: The Contest begins at 12:00 AM Eastern Time (ET”) on 5/1/17 and ends at 11:59 PM ET on 10/1/17 (the “Contest Period”). The Contest Period is broken into five (5) separate game periods (each a “Game Period”), each corresponding to a separate individual Game. To enter a particular Game Period, you must enter during the corresponding Entry Period indicated in the chart below, and select the Game Period for which you wish to enter, using the procedure set forth in Rule #4 below. Each Entry Period for the Contest begins on 3/29/17. Sponsor’s computer is the official time-keeping device for the Contest. Game Cards, Codes and Digital Game Cards (as defined herein) released in 2017 may only be used in the Game Periods set forth below.

2.     ELIGIBILITY: The Contest is open only to legal residents of the fifty (50) United States, the District of Columbia, and Canada (excluding Quebec) who are 21 years of age or older at time of entry. Void in the province of Quebec and where prohibited by law. Employees of Honus Bonus Partners LLC (“Sponsor”) and the Major League Baseball Players Association (“MLBPA”), as well as any respective subsidiaries, divisions, affiliates, manufacturers, and advertising, promotional and judging agencies of Sponsor and MLBPA in connection with this Contest, Sponsor’s independent contractors, agents and attorneys and those that have any affiliation with the Sponsor (Sponsor, the MLBPA Affiliates defined below, and the foregoing individuals and entities, collectively, the “Released Parties”), and the immediate family members (spouses, parents, children, and siblings and their spouses) and household members of MLBPA and Sponsor employees (whether related or not) are not eligible to participate or win. All federal, state, municipal, provincial and local laws and regulations apply.  An eligible entrant who submits an eligible Entry in accordance with these rules is referred to as an “Entrant”.

 

3.     DISPUTES: Except where prohibited, Sponsor reserves the right to make all decisions in its sole discretion arising out of or relating to the Contest, and the decisions by Sponsor are final and binding on all matters relating to the Contest. Except where prohibited, you agree that: (a) any and all disputes, claims and causes of action arising out of or connected with the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located closest to Sponsor in the Commonwealth of Pennsylvania; (b) any and all claims, judgments, and awards against any Released Party shall be limited to actual out-of-pocket costs incurred in entering the Contest, and shall in no event include attorneys’ fees; and (c) notwithstanding the foregoing, you waive the right to (i) claim, and in no event will any Released Party be responsible or liable for, any damages or losses whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages, and/or (ii) assert against any Released Party any claim of liability arising out of or in connection with the Contest and/or any prize awarded. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, and/or the rights and obligations of Sponsor, MLBPA Affiliates or other Released Parties in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the United States of America and the Commonwealth of Pennsylvania, without giving effect to any choice of law or conflict of law rules (whether of the laws of the Commonwealth of Pennsylvania or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Commonwealth of Pennsylvania.

 

4.     HOW TO ENTER:

 

A.     Game Cards & Codes:  Specially-marked packages of Honus Bonus Fantasy Baseball Cards will contain 8 cards (each a “Game Card”), each with a scratch-off area. With the side of a coin or your fingernail, gently scratch off the scratch-off area to reveal a unique Official Player Code (a “Code”). Each Code corresponds to a specific MLBPA player. The Code obtained from a Game Card will correspond to the player shown on the front of the card.  Before beginning the entry process using Codes obtained from a Game Card (or subsequently adding a player to your Team), you must register on www.honusbonus.com (the “Website”) each of your Codes corresponding to the players you wish to use in a Game. When you register a Code, the corresponding MLBPA player will be entered into your player collection, which can be found on the “My Collection” page on the Website. To enter a Game in the Contest during the applicable Entry Period (set forth in Rule #1), visit the Website, carefully follow the instructions to choose the corresponding Game Period and complete a corresponding entry form.  To complete the form, you must select 30 MLBPA players from your collection to create your fantasy baseball team lineup (your “Entry” or “Team”), following the rules set forth below in this Rule #4. You may only include on your Team those players for which you have obtained and registered Codes or obtained Digital Game Cards through the process set forth in Rule #4B.  Please retain your Game Cards for Code verification, if applicable.   

 

Each Entry/Team must consist of the following number of MLBPA players in the following positions:

 

No more than one player from each Location (described below) may be included in each Entry/Team. The location for each player is indicated on that player's Game Card and/or on or under the Digital Game Card shown in your collection.  The following list comprises the thirty (30) possible locations (each a “Location”), which correspond to MLBPA players’ respective actual professional baseball team affiliations:

In the event that during the Contest or an Entry Period a player changes the Location of his actual affiliation, and you have a printed Game Card, free Digital Game Card (see Rule #4B below) and/or digital representation in your collection for that player that reflects the player’s former Location, then that player’s former Location (i.e., the Location that appears on that player's Game Card, Digital Game Card or digital collection representation, as applicable) will remain in effect for throughout the Contest Period and any corresponding Entry Period.  If you do not have Codes or Digital Game Cards for a sufficient number of players in each position and/or from the appropriate Locations, then you will need to continue to build your player collection by obtaining additional Codes and/or Digital Game Cards until you have sufficient additional players to complete your Team.

 

Teams/Entries may only be used in the Game Period that you selected during the entry process, and must be received during the corresponding Entry Period indicated in the Game Period chart above in Rule #1. You may enter more than one Team in any Game Period, and you may enter in more than one Game in the Contest, but each Code may only be registered once, and each player in your collection (whether obtained through a Code or a free Digital Game Card) may only be used once (except as described in the paragraph below) during the entire Contest. Teams/Entries are not carried over into subsequent Game Periods. If you enter using your mobile phone, standard data rates may apply. See your wireless provider for pricing plan details. Entries generated by script, macro or other automated means and Entries by any means which subvert the Entry process are void. All Entries become the sole property of the Sponsor.

 

After submitting an Entry during an Entry Period, you may later remove and replace one or more player(s) from the Entry lineup (and make other changes to the lineup). Note that if you remove a player from your lineup before the corresponding Game Period begins, you may retain the removed player in your online collection and reuse such player in another Entry; but if such player is removed after the corresponding Game Period begins, you may not retain or reuse the player, or the registered Code and Digital Game Card corresponding to the removed player.  Other than that, you may only use each player in your collection (whether obtained through a Code or a free Digital Game Card) once, and in a single Entry.

Game Cards and unregistered Codes may be traded amongst entrants for use in any Game Period (subject to these Rules); however, if a Code has already been registered by an entrant, then that Code will be ineligible to be registered by another entrant in any Game Period. The entrants who are conducting the trade, and not the Released Parties, are responsible for determining whether a Code has been registered before making or accepting a trade. Code registrations cannot be reversed.

 

 

B.     Digital Game Cards: You can receive one or more randomly selected digital player cards to use in the Contest (each a “Digital Game Card”), without purchase, during the period from the date that Sponsor’s first releases Game Cards for the Contest Period (on or about March 29, 2017) to August 31, 2017, through completing the process detailed herein during such period. To receive free Digital Game Card(s), go to the Website and set up a free account. Then click on the “Get Free Game Cards” link on the main website page to submit your request for free, on-line Digital Game Card(s) (each a "Request"). In response to a properly submitted Request, you will receive an email with a link to claim the free Digital Game Card(s).  Remember to check you spam folders for the email.  When you click on the emailed link, the free Digital Game Cards will automatically be added to your online collection.  Go to your “My Collection” page to view your entire collection, including images corresponding to your free Digital Game Cards and registered Codes. 

 

The amount of Digital Game Card(s) you receive varies depending on how many prior times you have requested free Digital Game Cards.  The first Request received from an account will result in a link to retrieve thirty (30) randomly selected Digital Game Cards; each subsequent Request will result in a link to retrieve one (1) additional, randomly selected Digital Game Card at a time.

 

If your first Request is received during one or more Game Periods that have already begun and an Entry has not yet been created, then you will not be eligible to use the Digital Game Cards in any Entry for such ongoing Game Period(s).

 

The Released Parties are not responsible for lost, late or misdirected Requests or emails, or registration of Codes. Robotic or fraudulent Requests will not be eligible.

 

 

5.     HOW IT WORKS/WINNER DETERMINATION:

 

Your Entry/Team in a Game Period will be ranked amongst the other Entries/Teams in that Game Period, based on how the corresponding MLBPA hitters and pitchers perform in the actual professional regular season games (not including any minor league season games) that take place within such Game Period. The ranking of such performances will occur at the conclusion of a Game Period, based on the following 12 categories (each a “Category”): The “Hitter Categories” include Batting Average, Home Runs, Runs Batted In (RBI), Stolen Bases, Runs Scored, and On-base percentage Plus Slugging percentage (OPS): and the “Pitcher Categories” include Wins, Earned Run Average (ERA), Saves, Walks plus Hits per Inning Pitched (WHIP), Strikeouts and Holds.

 

Your overall ranking for your Entry/Team within a Game Period will be determined by an accrued average in an applicable statistical Category (e.g., Batting Average or Earned Run Average) or an accrued total number in an applicable statistical Category (e.g., Home Runs or Wins) in the manner contemplated in Rule #6 (such averages and total numbers, collectively, the “Statistics”). In each Hitter Category, Sponsor will determine the accrued statistical average of the performance or the accrued total number of the accomplishment (as applicable) for all of the hitters on your Team, in the manner set forth in Rule #6.   In each Pitcher Category, Sponsor will determine the accrued statistical average of the performance or the accrued total number of the accomplishment (as applicable) for all of the pitchers on your Team, in the manner set forth in Rule #6.  Statistics will be determined based on the statistics posted on the Website.

 

Sponsor will then award your Team points in each Category based on the ranking of your pitchers or hitters (as applicable) in that Category as compared to the other Teams in that Game Period. The better the performance in each Category (based on the Statistics), the higher the ranking you will receive; and the higher the ranking you receive in a Category, the more points your Team will receive for that Category. The highest number of points awarded in each Category depends on the number of Teams that participate in a Game Period.  For example, if 100 Teams participate in a Game Period, the highest-ranking Team in each Category would receive 100 points and the lowest-ranking team in each Category would receive 1 point.

 

Following each Game Period, the Entrant(s) who submitted the 10 Teams with the most combined points among all 12 Categories for such Game Period (i.e., the 10 highest ranking Teams) will win the prize indicated in the Prize chart below in Rule #8. A $100 Bonus Prize will be awarded to the Entrant(s) who submitted each of the Teams in a given Game Period with the highest ranking for each of the 12 Categories.

 

Your Team ranking will be determined based on the players who were active on your Team during the applicable Game Period.  You may change players on your Team at any time within a given Game Period (or the corresponding Entry Period), as long as your Team does not contain more than one player from each Location (as described in Rule #4). However, for purposes of the determinations contemplated in this Rule #5, Statistics may only be accumulated by those players who are active on your Team each day during that Game Period. Statistics may not be retroactively applied to any player or players who are subsequently added to your Team during the Game Period.  If a player is removed from your Team during the Game Period, only those Statistics accumulated by such player during the period beginning on the later of the start date of the Game Period or the date you added the player to your Team, through (and including) the date of that player’s last game when active on your Team will apply. Similarly, if a player is added to your Team during the Game Period, only those Statistics accumulated by such player after the date from which that player is added to your Team will apply.

7.     In the event of a tie, the tie will be broken based on additional statistics categories, applied in the following specific order, until the tie is broken: (a) Total Games Played for Hitters and Pitchers combined, (b) Hitters' Total At-Bats, (c) Pitchers' Fewest Bases on Balls Allowed, (d) Hitters' Total Bases and (e) Hitters' Fewest Times Caught Stealing.  If there still remains a tie after these additional statistics categories have been applied, time-limited baseball trivia Tie-Breaker Questions will be asked/administered via phone to the tied Entrants until the tie is broken. Each Entrant’s ability to win depends solely on (1) his/her knowledge of the game of baseball and professional baseball history; (2) his/her knowledge of the strengths and weaknesses and both historical and recent performances of MLBPA baseball players; (3) his/her skill in assessing MLBPA baseball players' likely effectiveness and in statistically analyzing and predicting with accuracy hitters’ statistics and pitchers’ statistics likely to be accomplished by MLBPA baseball players during each Game Period; and, (4) the number of eligible Entrants competing in the Contest.  Released Parties shall not be responsible if a tied Entrant is not available for or does not receive such call.

In addition to the above regular prizes, a $100 check bonus prize will be awarded to each highest ranking Team in each Category in each Game Period (totaling Sixty (60) such Honus Bonus Prizes during the Contest).

 

All federal, state, and local taxes are solely the responsibility of the winners. No transfer, assignment, substitution or cash equivalent for prize will be permitted, except at the sole discretion of the Sponsor due to prize unavailability for any reason, in such circumstance, an alternate prize of equal value will be awarded and the Sponsor’s obligation to the winner will be fulfilled, and no other additional compensation will be provided. No responsibility or liability is assumed for damages, losses or injury resulting from acceptance or use of prize. Limit one regular prize and up to twelve (12) bonus prizes per entry per Game Period. Sponsor is not responsible for postponement or cancellation of any Games. Subject to the terms of this paragraph, prizes consist of only the item listed as the prize. In the event that an insufficient number of eligible entries are received to award all available prizes, Sponsor is not obligated to award any remaining prizes.

 

9.     WINNER NOTIFICATION: Winners will be notified within 3 days after each Game Period concludes, by email and/or mail. Entrants with the highest ranking overall Teams in each Game Period, the First through Ninth Runners-Up Teams, and the highest ranking Team in each Category in each Game Period, will be emailed an Affidavit of Eligibility/Declaration of Compliance (as applicable based on state, province and/or country of residence), Release of Liability and a Publicity Release which he/she will be required to sign and return via fax or e-mail within seven (7) days of notification attempt (and send the original Affidavit or Declaration Form back via mail) or prize will be forfeited and the Entrant of the Team with the next highest number of combined points for that category may be determined as an alternate winner. Winners will be notified in ranking order (First Prize winner confirmed and then move to notifying Second Prize winner, etc.). Noncompliance with the foregoing response procedure within the applicable time period or the return of any prize/prize notification as undeliverable will result in disqualification without further notice and the Entrant of the Team with the next highest number of combined points for that category will be determined as an alternate winner.

 

10.  GENERAL RULES: All applicable federal, state, provincial and local taxes/duties on prize and any expenses relating to the acceptance/use of prize not specified herein are the sole responsibility of winner. All Codes and Game Cards are subject to verification.  In no event will more than the stated number of prizes be awarded. No fraudulent or duplicate Codes will be accepted, and the Released Parties are not responsible for any entrant’s use thereof. The entrants and winners agree to release, discharge and hold harmless Released Parties from and against any and all liability (including damages caused or claimed to be caused) arising out of participation and/or acceptance/use of prize, and agree to be bound by the Official Rules and the Sponsor’s decisions, which are final. Acceptance of prize constitutes permission for the Sponsor and its agencies to use winners’ names and/or likenesses for purposes of advertising and trade without further compensation, including a winners list, unless prohibited by law. Claims, including any claim against a Released Party, may not be resolved through any form of class action. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. All material submitted becomes the sole property of Sponsor and will not be returned. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prizes. NOTICE: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. The Released Parties are not responsible for faulty, incorrect, undeliverable, unreceived or mistranscribed phone/email transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user's ability to participate in the promotion. Sponsor and the other Released Parties assume no responsibility for undeliverable emails or messages resulting from any form of active or passive email filtering by a user's Internet service or phone provider and/or email client or for insufficient space in user's account, answering machine or voicemail to receive email or messages.

 

Sponsor reserves the right to cancel or modify the Contest if fraud, misconduct or technical failures destroy the integrity of the Contest; or if a computer virus, bug, or other technical problem corrupts the administration or security of the Contest as determined by Sponsor/judging agency, in their sole discretion. In the event of termination, a notice will be posted online and the winners will be determined per Game Period, as applicable and as outlined above. In the event a dispute arises regarding the identity of the entrant, Entry will be deemed made by the person whose name appears on the entry form. Any damage made to the Website by an entrant will be the responsibility of the entrant and/or the authorized email account holder of the email address submitted at the time of Entry. Proof of submitting Entries will not be deemed to be proof of receipt by Sponsor. Any entries which are suspected of being fraudulent (including those using robotic, automatic, programmed or similar methods of participation) will be disqualified, based on determinations made solely by Sponsor. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules. Neither Sponsor nor any of the other Released Entities makes any warranty, guaranty, or representation of any kind concerning the Contest or prizes and disclaim any and all implied warranties.

 

By entering and/or participating in this Contest, each entrant consents to receive one or more messages and/or emails from Sponsor, and/or be contacted by Sponsor for Contest purposes.  By entering and/or participating in this Contest, each entrant grants the Released Parties and their designees the right, unless prohibited by law, to use and publicize his/her name(s), user name, cities and states of residence, voice, avatar, photograph, image, statements and likeness, without compensation, notification or approval, for the purpose of the Winner’s List, advertising and publicizing goods and services and all matters related to the Contest, in any manner or medium, now known or hereafter devised, throughout the world, in perpetuity.  Each winner, by acceptance of the prize, grants to Sponsor and its designees the right to publicize such winner’s name, address (city and state/province of residence), photograph, image, voice, statements and/or other likeness and prize information for advertising, promotional, trade and/or any other purpose in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification, unless prohibited by law.

 

 

11.  PRIVACY: Any personal information that you provide in connection with the Contest shall be used by Sponsor to administer this Contest, contact entrants, and for the other purposes set forth in the Sponsor’s privacy policy located at www.HonusBonus.com/privacy. By entering this Contest you agree to and accept that privacy policy.
